The head of the Hamas Leadership Council, Mohammad Darwish, confirmed in a legal memorandum addressed to several Arab and Islamic countries, including Türkiye, that the approval of the law to execute Palestinian prisoners constitutes a dangerous shift in the Israeli legal system, warning that it grants formal legitimacy to gross violations affecting the right to life and human dignity, and undermines the foundations of international law.
Darwish explained in the memorandum, according to the official Hamas website on Wednesday, that this law does not merely represent a legal development, but rather a qualitative escalation that transforms killing from a field practice into a legal rule.
Darwish pointed out that this legislation comes within a broader context of extremist policies in prison management, especially since National Security Minister Itamar Ben-Gvir assumed his duties, where repressive measures against prisoners have escalated within the framework of a policy based on collective subjugation.
He called on Arab and Islamic countries and human rights institutions to take urgent action to stop the application of the law, and to impose binding international measures on the occupation state, including seeking to suspend its participation in international parliamentary bodies.
He also demanded the activation of international accountability mechanisms, especially by supporting the International Criminal Court, and opening investigations into criminal responsibility for the approval and implementation of this law, and providing immediate international protection for Palestinian prisoners.
The head of the Leadership Council in Hamas stressed the necessity of exercising intensive diplomatic and legal pressure to stop implementation of this law, and to prevent the use of the death penalty as a discriminatory tool, and to classify these practices as war crimes and crimes against humanity, to ensure that Israeli officials do not escape punishment.
